Editorial: Three Strikes Coming In?

Fight the Good Fight A battle is underway throughout Europe regarding the protection of online content (including videogames), in which governments, rights holders, ISPs and consumers are all weighing in and the resolution of which will have great importance for the games industry. The genesis of this battle lies in the dissatisfaction of rights holders (from music and film companies to games developers and publishers) at the legal regime on which they must currently rely upon to protect their content. With court proceedings slow, lengthy and expensive, rights holders have been lobbying for legislation to compel ISPs to take ‘technical measures’ to curb online piracy/copyright infringement over their networks. News: Developers "all pay the price" for some games’ content – Cage

Heavy Rain creator David Cage has expressed his frustration at the reputation of videogames perpetrated by a few titles which have been “over the top in a very and vulgar way” – titles which have since made it hard for developers to deal with adult content in games, even when its in context. While Cage didn’t mention specific titles, he did stress that he didn’t believe sex and violence in games for its own sake was a good thing. “As a game creator I have one very simple rule: Everything is allowed, no limits, as long as it makes sense in the story and is not gratuitous,” he explained during a developer session at this year’s Eurogamer Expo. News: Iwata: Wii sales have stalled

Nintendo’s president Satoru Iwata has admitted that sales of the Wii console have stalled, in part due to a lack of must-have software. The company released data yesterday that showed sales of the home console were down over 40 per cent in the six months to the end of September 2009, with 5.75 million Wii’s sold worldwide, compared to 10 million the previous year. “Wii has stalled,” Iwata told a press conference, reports Andriasang. “We were unable to continually release strong software, and let the nice mood cool. We were unable to show a new game to become ‘the next thing.’ In the game market, once you’ve lost the momentum, it takes time to recover,” he offered. Read more…

Square Enix has issued a revision to its 2010 fiscal year financial forecast, lowering its estimated first-half profit by 65 per cent to JPY 2.6 billion (USD 28.4 million). The company blamed a number of “special factors” for the forecast revision, including an unfavourable exchange rate and the cost of premium severance packages for staff laid off. Net income for the full year, ending March 31, 2010, was lowered 33 per cent, from JPY 15 billion to JPY 10 billion, indicating most of the severance payments will be absorbed in the first half period. News: iPhone goes on sale in China

The iPhone formally went on sale in China today following a series of delays caused by government regulations and alleged problems with operator deals. However, the phone continued to be blighted upon launch, with complaints surfacing about its high price – CNY 6999 (USD 1024 / GBP 621) for the high end 3GS 32GB model without a service plan – which compares unfavourably to those of imported iPhones sold at unofficial outlets. The handset also lacks wi-fi functionality, which was left out after the government temporarily banned it. The ban was subsequently reversed in May, but was too late for manufacture of the wi-fi free iPhones bound for the Chinese market to be halted. Read more…
